Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Mon Louis Ventures LLC (“YaySong,” “we,” “us,” or “our”) governing your use of the YaySong app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

YaySong lets you create personalized songs about the people in your family by providing names, details, and photos. The Service then creates songs you can play back and save.

Eligibility and your account

You must be old enough to form a binding contract where you live to use the Service. You are responsible for the activity that happens under your account and for keeping your login credentials secure. Please let us know promptly if you believe your account has been used without your permission.

Your content

You keep ownership of the names, details, photos, and other materials you submit (“Your Content”). You grant us the limited permission needed to process and use Your Content to operate the Service and create your songs.

You represent that you have the necessary rights and permissions to submit Your Content, including any names, likenesses, or photos of other people, and that doing so does not violate the law or anyone else’s rights.

Songs you create

Subject to these Terms, you may use the songs you create with the Service for your own personal, non-commercial use. Songs are generated automatically based on the inputs you provide, and results may vary; we do not guarantee that any song will meet your expectations.

Acceptable use

You agree not to use the Service to:

• Break the law or infringe anyone’s rights.
• Submit other people’s personal information without the right to do so.
• Upload content that is harmful, abusive, hateful, or otherwise objectionable.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service.

Payments

Some features of the Service may be offered for a fee. If you purchase a paid feature, the applicable pricing and terms will be presented to you at the time of purchase.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, YaySong and Mon Louis Ventures LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising out of or related to your use of the Service.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws rules.
